These Terms and Conditions govern the use of the Legacy mobile app (“Legacy App”) and related services.

1. Introduction

These Terms and Conditions apply to the services accessible to you (the “Services”) via our mobile application (the “Legacy App”). Each time you access the Legacy App, you agree to be bound by these terms and all applicable laws and regulations relevant to the Services. These Terms form a legal agreement between you and Legacy. By using the Services, you confirm that you have read, understood, and agree to be bound by them.

Our Privacy Policy also contains important information about how we collect and use your data. Please continue using our Services only if you agree to both documents.

We may revise these terms at any time and notify you of updates. You may need to download the latest version of the Legacy App and accept new terms to continue using the Services.

2. Accessing our Services

You confirm that you are over 17 years old and legally able to enter a binding agreement with us. The Services are not directed to anyone under 18. If you are under 18, do not use or access our Services.

You must either own the device you use or have the owner’s permission to install the Legacy App. You are responsible for any use of the App on that device and agree that Legacy is not liable for unauthorized access to your information resulting from shared or unsecured devices.

3. Our Services

Our Services include biography discovery, AI-generated historical learning paths, short interactive lessons, and related educational tools designed to help you learn from influential lives.

Legacy may modify, restrict, or remove features or content at any time without obligation to maintain specific offerings.

4. Educational Content Disclaimer

The Services are provided for educational and informational purposes only. They are not professional legal, medical, financial, therapeutic, or career advice. Legacy cannot guarantee specific personal outcomes from using the Services.

By using the Services, you accept sole responsibility for the accuracy of information you provide and for how you choose to apply any insights generated by Legacy.

5. Your Account and Profile

To access certain features, you may need to create an account and set a password (or use another secure authentication method). You are responsible for maintaining confidentiality and for all actions taken under your account.

Your account is personal and non-transferable. You agree to provide accurate, current, and complete information, and to keep it up to date. Notify Legacy immediately if you suspect unauthorized use of your account. Legacy is not liable for losses caused by failure to safeguard credentials.

6. Fees and Payment

Access to Legacy may require a paid subscription, available on a monthly or annual basis. Subscription purchases and payments are processed through third-party app store providers such as the Apple App Store or Google Play Store, and by subscribing you also agree to their applicable terms and conditions.

Your subscription will automatically renew at the end of each billing period unless you cancel at least 24 hours before the renewal date. If you do not cancel before renewal, you will be charged for the next period. Subscription management, including cancellation or changes, must be done through your app store account settings.

Legacy may change subscription prices from time to time and will notify you in accordance with app store policies. If you do not wish to continue your subscription at the new price, you must cancel before the next billing period begins.

Refunds for subscriptions purchased through the Apple App Store or Google Play Store are handled directly by those providers. Legacy cannot process or provide refunds for such purchases.

7. Promotional and Marketing Offers

From time to time, Legacy may offer promotional discounts, free trials, or credits in connection with subscriptions. These promotions may include eligibility requirements, expiration dates, or other conditions specified at the time of the offer. Legacy reserves the right to modify or withdraw promotions at any time or to revoke benefits if a user is found to have acted dishonestly or in bad faith.

8. Our Ownership Rights

The Services and the Legacy App contain software, logos, images, text, and other materials (collectively “Legacy Content”). All Legacy Content and its arrangement are the property of Legacy and its licensors, protected by intellectual property laws.

Legacy grants you a limited, personal, non-transferable, non-sublicensable, worldwide, and non-exclusive licence to use the Legacy App and Content solely for your personal use in accordance with these Terms. This licence may be revoked at any time without notice.

You agree not to copy, modify, reverse-engineer, decompile, or otherwise attempt to extract the source code of the Legacy App. You may not sell, lease, redistribute, or sublicense the App or its content. All trademarks and intellectual property remain the property of Legacy or its licensors.

9. Acceptable Use

You agree not to post or transmit through the Services any material that:

• is threatening, defamatory, obscene, offensive, or otherwise likely to cause harm;
• infringes another’s intellectual property or privacy rights;
• contains malicious code, viruses, or spam;
• collects or solicits data from users without their consent; or
• encourages unlawful behavior or harassment.

You also agree not to hack, overload, or disrupt Legacy’s systems, or use the Services in ways that could damage or impair their performance. Legacy reserves the right to suspend or terminate any account that violates these conditions.

10. Termination of Services

Legacy may suspend or terminate your access if you breach these Terms or misuse the Services. In such cases, you are not entitled to a refund, and your rights to use the Services will immediately cease.

We may also modify, suspend, or discontinue parts of the Services at our discretion, with notice where possible. You agree that Legacy will not be liable for such changes or discontinuations.

You may stop using the Services at any time by deleting the Legacy App and cancelling your subscription via your app store account settings. Deleting the app does not automatically cancel a subscription.

11. Links to and from Other Apps and Websites

The Services may contain links to third-party content, surveys, or external sites. These are provided for convenience only. Legacy does not control and is not responsible for the content, security, or privacy practices of external sites. Accessing third-party links is at your own risk.

12. Indemnity

You agree to indemnify and hold harmless Legacy, its affiliates, officers, directors, employees, and agents from any losses, damages, liabilities, or expenses (including reasonable legal fees) arising out of or related to:

• your breach of these Terms or applicable law;
• your misuse of the Services;
• any content you submit or provide through the Services;
• your infringement of intellectual property or privacy rights; or
• your failure to provide accurate, up-to-date information.

13. Disclaimers

The Services are provided “as is” and “as available,” without any warranties or conditions, except as required by law. Your use of the Services is at your sole risk.

To the fullest extent permitted by law, Legacy disclaims all express or implied warranties, including but not limited to fitness for a particular purpose, merchantability, accuracy, or non-infringement. Legacy does not guarantee that the Services will be error-free, secure, uninterrupted, or that they will produce specific results from educational use.

14. Limitations and Exclusions of Liability

Nothing in these Terms limits Legacy’s liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation.

Subject to that, Legacy will not be liable for:

• economic losses including lost profits, contracts, data, or business;
• loss of goodwill or reputation; or
• any indirect or consequential losses, even if foreseeable.

Legacy’s total aggregate liability under these Terms will not exceed the total amount you paid for the Services in the six months prior to the claim.

15. Dispute Resolution

To the fullest extent permitted by law, any dispute, claim, or controversy arising out of or relating to these Terms shall be governed by the following provisions:

1. Time Limitation: Any dispute must be brought within one year of the event giving rise to the claim, excluding periods of informal settlement discussions.
2. No Class or Representative Actions: You and Legacy agree to bring disputes only in an individual capacity, not as part of a class action or collective proceeding.
3. No Consolidation: You and Legacy waive the right to participate in consolidated actions.
4. Jury Trial Waiver: Both parties waive any right to a trial by jury in connection with any dispute.

If you do not agree with these provisions, you must not access or use the Services.

16. General

These Terms and your relationship with Legacy are governed by the laws of Italy. If you are an EU consumer, you may also rely on mandatory consumer protection laws in your country of residence. Both you and Legacy agree to the non-exclusive jurisdiction of the courts of Milan, Italy, except that Legacy may seek equitable relief in any jurisdiction.

Legacy is not liable for delays or failures caused by events beyond its reasonable control, such as natural disasters or network outages. During such events, our obligations will be suspended until performance can reasonably resume.

No other person has rights under these Terms except you and Legacy. We may transfer our rights and obligations to another organisation provided your rights are not affected. You may only transfer your rights with our written consent.

Failure to enforce any provision shall not constitute a waiver. If any provision is found invalid, the remaining provisions will remain fully enforceable. These Terms constitute the entire agreement between you and Legacy regarding the Services.
